Fee Agreement


(1.) I/We______________________________, hereinafter referred to as “the undersigned”, “Taxpayer”
or “Owner” enters into this agreement with Hudson Harbor Realty Corp L.L.C, to retain the services of Hudson Harbor Realty Corp and or its assigns as our agent and research consultants for the subject property in regards to a tax appeal filed on behalf of the owners.

(2.) As the property owner, you will have the opportunity to engage the services of an attorney to represent you in this tax appeal, if you should choose to do so, a separate agreement will be provided by the attorney.

(3.) Hudson Harbor Realty Corp will be paid a flat fee of _______ for consulting services in this tax appeal matter, with the taxpayer or owner responsible for the necessary filing fees for the appeal. Hudson Harbor will provide you with the necessary inspection and appraisal reports done by a licensed New Jersey appraiser. The Value of the appraisal report will be utilized in determining a market value of the property as well as a chapter 123 analysis to help determine what your assessment should be based on that value. We will also accompany you to your hearing and provide you with the necessary testimony regarding value in your tax appeal.

(4.) The appraisals provided by Hudson Harbor Realty Corp and or its appraisal staff are independent appraisals, and the values of the appraised properties are not contingent on any fee agreement.

(5.) The fee due Hudson Harbor Realty Corp LLC will be paid upon the filing of the appeal process and is not contingent on any value derived after the inspection of the property. Hudson Harbor will be responsible for any fees paid to independent appraisers utilized in this tax appeal process.

(6.) The valuation date will be October 1st, of the tax year and the reports are done for tax appeal
purposes only and are not to be used for any other purpose. Copies of the report will be supplied to the Municipal assessor and The county Board of Taxation as required in a timely manner.

(7.) The property owner/taxpayer also agrees that in the event they are dissatisfied with the results of the Tax Boards decision regarding the appeal and that they wish to further the appeal process to The State Tax Court, that they are responsible for additional filling fees and Appraisal fees in order to continue their case in State Tax Court. These appraisal fees will be negotiated on an individual case by case basis.

(8.) The taxpayer also agrees to make available to Hudson Harbor their property which is the subject of this appeal for an inspection , on certain properties the tax assessor may request an inspection of the property by his office ,and the property owner also agrees to make the property available to the assessor’s staff for an inspection.

(9.) The property owner also agrees to hold harmless Hudson Harbor Realty Corp. and its appraisers for any disputes arising from the tax appeal process and agrees to pay Hudson Harbor Realty corp. reasonable attorney fees in the event a dispute arises from this process. The owners also agree to pay 1.5% interest monthly on any unpaid balances due Hudson Harbor Realty Corp and any attorney fees which should arise as a result of a collection effort.
